When does the argumentative attorney, trying to advocate for his client, cross the line of civility in court? How does the bench control proceedings when arguments are calculated to be confusing or lengthy with the use of chronic delay tactics and/or abusive discovery techniques? How should council respond to offensive and/or disparaging remarks during court proceedings or in private discussions with opposing council? Philosopher, Eric Hoffer proposes, “Rudeness is a weak man’s imitation of strength.” In this judicial perspective, Judge Jaime Roman, using vignettes for discussion, will address how less-than-civil conduct can and will affect your argument, your reputation, and ultimately impugns the integrity of the legal system for all.
